Respecting your privacy
We take your right to privacy seriously and will act in a lawful manner to protect your personal information. We will comply with all applicable UK Data Protection and consumer legislation that is in place from time to time.
Circumstances under which we collect personal information
We may collect personal information from you when you:
- register on our website
- purchase goods from us
- telephone us
- write to us
- enter competitions or prize draws
- take up any special offers or discounts.
Personal information we collect
The Personal Information that we may collect from you and retain is your:
- name
- website user name
- postal address
- telephone and/or mobile numbers
- email address, and
- records pertaining to the nature of your purchase.
You have control over the information we store about you and what types of information (if any) you would like to receive from us. You may request a copy of the information that we hold about you by contacting us in writing. We reserve the right to make a reasonable charge for doing so.
Blog
Any comments or replies which you submit in response to or in reply to PoGo's blog are deemed to be information intended for public access. Your submissions will be approved by the site administrator and, if approved, made publicly available on the blog. If you wish us to remove any information you submitted in relation to the blog which we have already posted on the website for public viewing, please contact us. We reserve the right not to remove that information if we believe there is a good reason why we should not remove it. If we agree to remove your comments, we will do so within a reasonable period of time.
How we use your personal information
We will use the personal information that you provide to us to:
- process your order
- arrange delivery
- handle the administration of our website and our business
- undertake any statistical analysis of our business
- undertake and process any surveys o improve our website and the services it provides to you
- contact you about the products or services we have provided to you
- send you information relating to the interests that you have selected upon registration.
You agree that PoGo may contact you by email or letter for any of the purposes in (1) to (7) above and you confirm that you do not and will not consider in the future any contact from PoGo in accordance with (1) to (7) above to be a breach of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.
We may seek your permission to send you further information about our products, our services or developments within the business, or to request feedback about our products or services. If you decline to receive any or all such information by email and/or post, we will honour your decision.
We will not contact you in the future unless you have given us your consent.
We will only telephone you if we have a query on your order, or if you have provided a contact number for the purpose that we may telephone you about other matters.
The protection of children under 12 years of age
The protection of children is of paramount importance to PoGo. Our website is aimed at girls between the ages of 8 and 14, and designed to be a safe environment for them to access information about periods and puberty.
We insist that children under 12 have parental consent to register on our website and encourage their parents to satisfy themselves as to the suitability of content on our website for their children. This may necessitate the parent or guardian registering on the site in order to access the restricted areas, and we will cancel their registration at any point subsequently if they should so desire.
We follow the Guidelines set out by the Information Commissioner's Office and Trust UK which states that information should not be collected on a website from children under 12 without first obtaining the permission of a parent or guardian. The ticking of a box by a child under 12 to confirm they have parental consent is deemed insufficient.
Information Commissioner's Office Guidelines
In a practical sense, it is not possible to obtain parental consent unless the child has provided the necessary contact information for the parent/guardian.
On the registration form, we ask for confirmation of the person's email address and age. If they are under 12, we ask for the child's first name and the parent's or guardian's email address. We then notify the parent/guardian that that child has requested to register on PoGo's website, and any other information the child has requested to receive in the future, eg competitions.
The child cannot access the website until the parent/guardian has notified us of their agreement by email. When we have received an email from the parent or guardian', we will either:
(a) enable the child's access to PoGo's website and notify the child that their registration has been approved, or
(b) prevent the child from accessing PoGo's website by deleting the information we hold about them within a reasonable time. We are obliged to delete all information provided by the child, and we will also delete the parent/guardian's email address. We cannot email the child to tell them that parental consent has been withheld and would ask that the parent/guardian advise the child of their decision.
Please note that if the child registers once reaching the age of 12 the parent/guardian would not be notified (which is in accordance with our usual registration process) as we would no longer hold any previous record of the child's or the parent/guardian's details.
If a child under the age of 12 registers but fails to provide an email address for a parent or guardian, we will cancel their account. We will notify the child that their account must be cancelled and explain why. The child will be invited to re-register provided that they supply the email address of a parent or guardian. We will not engage in any further communication with the child.
Parents/guardians may notify us at any time in the future if they wish to cancel or change their child's registration with us. PoGo reserves the right to verify the identity of the parent/guardian contacting us before we undertake any such cancellation or change of the child's registration.
Your right to decline contact or unsubscribe
When you register on PoGo's website, you will be given the option to request information from PoGo by email about other interests you have. In order to receive information about your interests, you must select the relevant box or boxes on the registration page.
You have the right to unsubscribe at any time from our mailing list for all or any of the interests you choose at registration. You can notify us of your wishes by clicking on the email link at the foot of any communication from us, by emailing us via our Contact form or by telephoning us on 01727 762443 between 9.00am and 5.30pm Monday to Friday.
We will use our best endeavours to ensure that any information we hold about you is accurate and up to date. We will use our best endeavours to promptly correct any errors and make any alterations upon notification by you and you must allow us a reasonable period of time within which to make these changes.
Third parties
Your personal information will not be passed to any third party for any reason, other than
to third parties who may assist PoGo in:
- the processing of your order
- delivering your order
- undertaking administrative tasks for the purpose of running PoGo's business
unless we are required to do so in order to comply with UK or EU law, or requested to do so by the police or any other regulatory or government authority.
PoGo requires all such third parties to treat your personal information as confidential and to fully comply with all applicable UK Data Protection and consumer legislation in place from time to time.
Cookies
Cookies do not harm your computer. They are tiny text files and do not contain any personal information. Our website uses cookies so that:
- you can log in once you have become a registered user
- your website preferences are preserved
- you can save items to your shopping cart and retrieve your shopping cart to review your order.
Your web browser will need to have cookies enabled in order that you can register and shop at PoGo. Unless you have specifically disabled cookies your web browser will have enabled them automatically.
Changes to our Privacy Policy
We reserve the right to alter our Privacy Policy at any time without prior notice. Any alteration will be displayed on our Website and we will notify you in writing if we deem such notification appropriate.
